Dixon's Auction Terms & Conditions THIS IS AN INTERNET ONLY AUCTION Please see individual auction details for Live Inspection days/times and On-¬Line Bidding Auction Ending days/times and Merchandise Removal days/times. Are you new to Internet Auction Bidding? Internet auctions are similar to live auctions. By Registering, You are agreeing to the terms & conditions set forth by Powhatan Auctions Inc. DBA Dixon's Auction. Please read the terms & conditions carefully. WHAT IS AN AUCTION: An auction is a legally binding contract offer by the high bidder to purchase. All items are sold "as is / where is" with no guarantees or warranties, expressed or implied, of any kind, including but not limited to condition, suitability or merchantability for any purpose. This is NOT a retail store, and ALL SALES ARE FINAL, and NO credits or refunds of any kind are given. You are bidding and buying based upon your own inspection, your own determination of value, and your own decision to bid. Attending A LIVE PREVIEW IS YOUR BEST PROTECTION! REGISTER: You will be registering by credit card (Visa/MC/Amex/Discover) via our secure site. We do not share this information with any outside sources. This is solely for your bidding participation with us. NOTE: You MUST have available balance on your registered credit card to cover your on-line auction purchases. Once you have registered, you are ready to begin bidding. PREVIEW: For any Dixon's on-line auctions, there will be posted Live On-Site/In-Home preview time available. LIVE PREVIEW IS VERY IMPORTANT! This is your only real opportunity to determine the condition, usefulness, and any other purchase criteria to make your own informed bidding decisions. The pictures and descriptions given on-line are limited in nature, and in no way represent any guarantee or warranty of any kind. We take no responsibility for errors or omissions of any kind in photographs or descriptions. BIDDING: All bidders are required to register on-line in order to bid. You must have available balance on your credit card for your online purchases. WHEN YOU BID ON ANY ITEM, YOU ARE ENTERING INTO A BINDING CONTRACT. IF YOUR BID IS THE WINNING BID ON ANY ITEM(S), YOUR CREDIT CARD WILL BE CHARGED FOR EACH AND EVERY ITEM PURCHASED AND YOU WILL BE REQUIRED TO PICKUP YOUR ITEMS. When the auction closes, your credit card will be charged for your purchases and an invoice emailed to you. You will need this printed invoice in order to pick up your purchases. (NO EXCEPTIONS!) Out Of State Bidders: If you are an out of state bidder Dixon's will help arrange shipping at bidders expense (Shipping/Handling Fees Apply) Please notify Auctioneer by email at billy@dixonsauction.com if you want to make other arrangements. Storage fees will apply ($5.00 per day, per item) if purchases have to be stored at Dixon's Auction. MAXBID: The MAXBID feature allows the computer to bid on your behalf until the MAXBID you specify. This protects you from losing an item to a "last minute bidder" for less than you might have been willing to pay. If you want to win the auction, use the MAXBID feature! If you want to raise your bid place a bid in the "MAX" area only!! Please be aware that many bidders routinely increase their own bid to price an item out of reach of other bidders. You should immediately review your bids once submitted. STAGGERED CLOSING: The online auction closes multiple items per minute This feature will close the bidding at pre¬determined intervals, in catalog order. This feature works great with the Dynamic Closing feature to closely emulate a 'live' auction, which allows bidding to continue while active, then closing an item when a given state of inactivity has been reached. BID NOTIFICATION: If you have been outbid you will be notified by email UNTIL the last day of the auction. As of midnight EST the night before Auction Closing Day outbid notifications are no longer sent. Otherwise, on the last day there could be an overwhelming number of email notices in your mailbox. Participating bidders should check their bid status frequently throughout the Auction Closing Day. BUYERS PREMIUM: A 18% Buyer's Premium will be added to each purchase. Example: You bid $100.00. At check out you will be charged $118.00 (plus VA State Sales Tax If You Are A Virginia Resident). PAYMENT: If you win, we will charge your credit card for your purchases and CONTACT YOU BY EMAIL ONLY. If you are not contacted then you did not win any items in the auction. Remember, you need your printed invoice to pick up your purchases! SALES TAX: VA State Sales tax will be collected. If you are tax exempt, you must fax a copy of your tax exempt form prior to the conclusion of the online bidding. EMAIL YOUR FORMS TO: dixonshipping@gmail.com (VA. Residents Only) REMOVAL: Removal days/times are posted within each specific auction. By participating and bidding in a given auction, you understand and agree to abide by the removal days/times for that auction. PLEASE DO NOT BID IF YOU ARE NOT ABLE TO PICK UP YOUR ITEMS during the scheduled removal times. NO refunds, credits or charge back's will be granted due to a lack of removal at the designated times. After the scheduled removal, items will be considered abandoned and you will be charged a removal fee for disposal of your unclaimed items. YOU MUST BE AVAILABLE TO PICK UP AND REMOVE YOUR ITEMS AT THE POSTED REMOVAL TIMES. Bidders who do not pickup their items at the scheduled time will be considered to have abandoned their purchases and agree that they will not be entitled to any refund or adjustment. In the event an item is not available for pickup,(Due to unforseen circumstances) the buyer must notify the auctioneer immediately by email at billy@dixonsauction.com within 24 hours of the auction pickup/ removal date. After 24 hours, the Auctioneer and buyer agree that they (buyer) have abandoned their purchases and agree that they will not be entitled to any refund or adjustment. Bidders are responsible for their own removal. **ANYONE PICKING UP MERCHANDISE ON YOUR BEHALF MUST HAVE YOUR ORIGINAL SALES RECEIPT. DUPLICATE SALES RECEIPTS FOR PICKUP CAN ONLY BE OBTAINED FROM THE AUCTIONEER. NO EXCEPTION! Any item NOT picked up by the set time will be considered abandoned. Removal shall be at the expense, liability, and risk of the purchaser. Purchases will be released upon presentation of a paid receipt. Please insure that movers or anyone picking up items on your behalf have your paid receipt at the pickup location. IMPORTANT! The Auctioneer will have the option of reselling, removing, storing or abandoning, at the expense and risk of the purchaser, any items not paid for and/or removed within the specified time. The buyer agrees to pay all deficiencies, legal, collection; transportation and storage expenses associated with delinquent accounts or abandoned items. PROTECT YOUR PURCHASES: While we have designated checkout personnel, we, nor our clients can be held liable for replacing any lost, stolen, or missing items, or exchanged parts or equipment. Ownership transfers to the high bidder when the Auctioneer announces "SOLD", or final sale is otherwise indicated. CHOOSE WISELY: We want everyone to get a good deal and most will. However, when you bid on the wrong item or decide an item is not suited for your intended use, our clients are not willing to assume the cost of your mistakes. When in doubt about condition, completeness or Suitability for intended use, please bid accordingly. The auctioneer reserves the right to add or remove items from the auction. LIMITATIONS: The above-stated Conditions of Sale cannot be altered except in writing by The Auctioneer. Any controversy or claim arising out of or relating to this contract and/or agreement, or breach thereof, shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, and judgments upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
